1. Privacy policy

Data security and data protection is an important concern for us. As a serious and reliable intermediary, it is our duty to ensure both the security of data transmission and, without doubt, confidential handling of your personal data always. For this reason, we would like to inform you below about the collection, processing and use of personal data in the context of the use of our website and the (financial) services we offer. Personal data in this sense means any information that allows conclusions to be drawn about an identified or identifiable natural person. The provisions of this privacy policy may be amended from time to time. Accordingly, we would recommend that you review this Privacy Policy periodically for updates.

The responsibility under data protection law for our presence in social networks as well as for linked external content does not lie with us, but with the operator of the corresponding social network or the service providers of the corresponding linked internet presence.

We process your personal data in order to make our website available to you, to process your contact inquiries, to assist you in selecting a loan and accordingly to provide you with information, e.g. on suitable products. We also do this only for the respective purpose and only to the extent permitted by law, either based on your consent (e.g., in the case of marketing services), for the performance of a contract (in the context of loan brokerage) or based on our legitimate interest (e.g., in the case of making our website available).

Accordingly, the following information will explain to you how we, AMA Capital, process your personal data. Among other things, you will learn for what purposes and on what legal basis we collect, use or process your personal data, how long we store them and which rights you have in relation to your data. We also inform you with whom we share your data and how you can contact us if you have any questions.

2. Processing of personal data

We process personal data only,

a) when visiting our website. We use cookies and similar technologies on our website at https://www.owusucapitalpartners.com to track your usage behavior. For more information on cookies, please refer to point 5. cookies.

We delete your usage data when it is no longer required for IT security purposes. Beyond that, we only store your usage data to fulfill any legal retention periods.

b) In the context of loan brokerage. When arranging a loan, we process the information that you provide to us within your self-disclosure form: Personal details/documents such as name, address, e-mail address, telephone numbers, dates of birth, nationality, bank details, etc.

We process this data based on Art. 6 (1) lit. b DSGVO in order to be able to arrange a loan.

During data economy, we would ask you not to provide us with any personal data that goes beyond what is necessary. You are welcome to remove or make unrecognizable such information (such as information from bank statements that are not relevant for the further process) beforehand. In all other cases, this data is processed exclusively based on prior consent (Art. 6 (1) a DSGVO), which is deemed to be given if the information is sent accordingly. You can revoke your consent at any time for the future.

Here too (as in the following sections), the data will only be processed for as long as is required for the purpose of processing and fulfilling the contract. Beyond that, we will only store your personal data for the purpose of fulfilling any statutory retention obligations or until relevant civil law legal claims relating to the loan brokerage have become time-barred (Art. 6 para. 1 lit. c EU-DSGVO). The periods for retention or documentation specified in the German Commercial Code (HGB) and the German Fiscal Code (AO) are, for example, six to ten years.

c) when you contact us. If you contact us regarding a consultation appointment, a callback, with questions or similar, we will process information/documents about you, such as your name, e-mail address, telephone numbers, company and the content of your inquiry. We process your personal data for this purpose based on Art. 6 (1) lit. b and f DSGVO in preparation for a contractual mediation relationship with you.

We will share your data with affiliated companies, external service providers or other third parties to the extent disclosed in this privacy policy. These third parties have been selected by us with due care and, if they are commissioned data processors, have been commissioned accordingly with data processing. The processors are used by us based on corresponding contractual agreements and within the framework of the legal requirements. Data may also be transferred to a third country outside the EU/EEA (e.g. USA). Such a data transfer takes place exclusively based on an adequacy decision (Art. 45 EU-DSGVO) and/or subject to appropriate guarantees (Art. 46 EU-DSGVO).

The personal data of the data subject shall be deleted or blocked at regular intervals after the purpose of storage ceases to apply. If storage or recording obligations are provided for due to relevant European or national laws or other regulations, the personal data will be stored for the prescribed period and then deleted.

3. Transfer to third parties

Personal data is transferred to our partners and vicarious agents who support us as order processors in the provision of services described above. The transfer takes place based on Art. 6 para.1 lit. f DSGVO. Our interest here is predominantly to use effective and specialized service providers who are strictly subject to our instructions in accordance with Art. 28 DSGVO

Within AMA Capital, access is only granted to those offices that need it to fulfill our obligations. This transfer takes place through the fulfillment of the contract in accordance with Art. 6 Para.1 lit. b DSGVO.

Personal data will be transmitted to third parties outside AMA Capital if this is necessary for the fulfillment of the framework agreement on the brokerage of a loan or if you have consented to this. Such recipients of personal data are, for example:

I.Banks, building societies or insurance companies and institutions under public law or comparable institutions to which we transmit personal data in order to carry out the brokerage;

I. other payers or payees for accounting purposes; and

III. public agencies and institutions, such as tax authorities, law enforcement agencies in the event of a legal or official obligation.

In addition, we transmit your personal data to authorities, courts or organizations insofar as this is necessary to protect the legitimate interests of us or third parties. Reasons for this may be the assertion of legal claims and the defense in legal disputes, the guarantee of IT security and IT operations of AMA Capital or the prevention and investigation of criminal offenses. In the event of such a transfer, we will inform you separately in accordance with the requirements of data protection law.

4. Data subject rights

According to the applicable laws, you have various rights regarding your personal data. If you wish to exercise these rights, please send your request by e-mail or by post, clearly identifying yourself, to the above address of the data controller.

You have the possibility to request information about the data stored about you, its origin, recipients or categories of recipients to whom the data is disclosed, as well as the purpose of the storage (right to information).

You have a right of rectification and/or completion vis-à-vis the data controller if the processed personal data concerning you is incorrect or incomplete (right of rectification).

You may request that the personal data concerning you be deleted without undue delay. However, there is no right to erasure if legal, regulatory or other sovereign retention obligations conflict with this (right to erasure).

You may, under certain conditions (disputed accuracy, unlawful processing, cessation of the purpose of processing or lodging an objection), request the restriction of the processing of personal data concerning you (right to restriction of processing).

You have the right to receive the personal data concerning you that you have provided to us in a structured, common and machine-readable format (right to data transfer).

You have the right to object at any time, on grounds relating to your situation, to the processing of personal data concerning you (right to object).

In addition, pursuant to Article 77 EU GDPR, you have the right to lodge a complaint with the supervisory authority if you consider that the processing of personal data is not carried out lawfully (right to lodge a complaint with a supervisory authority).

5. Cookies

We use cookies to make the website easy and convenient to use. When you visit one of the pages of the website, the servers send a cookie to your computer.
